Abstract: The article provides a comprehensive analysis of the Chapter on Trade and Sustainable Development (TSD) as a key predictor of long-term economic development and an institutional mechanism for strengthening economic security, boosting competitiveness, and accelerating the circular transformation of EU partner countries within the current trade governance framework. The author reviews the evolution of EU trade policy – from the 1999 Helsinki European Council and the «Global Europe» Strategy to the six strategic priorities outlined in the 2022 European Commission Communication «The Power of Trade Partnerships» – confirming the institutionalization of TSD as a mandatory, cross-cutting element of all modern free trade agreements. The article identifies a structural shift from a «soft» model of cooperation and consultation (notably, the 2011 EU–South Korea Agreement) to a «hard» implementation model, which envisages legally binding provisions and the application of sanctions in the event of violations of environmental, labor, or climate commitments, as demonstrated by the EU–New Zealand and EU–Chile Agreements of 2023. A comparative analysis of the governance philosophy of TSD in the EU and the USA (USMCA agreement) revealed conceptual and institutional asymmetries: while the American approach relies on coercive and punitive dispute resolution mechanisms, it simultaneously creates risks of «green protectionism,» regulatory fragmentation, and macroeconomic instability. It has been shown that the implementation of TSD provisions has a multiplicative effect on achieving the Sustainable Development Goals (SDGs) and facilitates the transition to a circular and resource-efficient economy through autonomous regulatory instruments, notably the Ecodesign Regulation and the Batteries Regulation, which establishes a mandatory digital battery passport. It has been determined that the TSD serves as a key institutional instrument for mitigating the environmental impacts of trade, promoting innovative growth, and developing responsible supply chains, while also generating systemic risks associated with the cross-border transfer of environmental hazards and the limitation of regulatory sovereignty. Strategic recommendations have been proposed to enhance the effectiveness of the TSD, including: the development of a unified sanctions mechanism for dispute resolution, the implementation of standardized models for assessing the circularity of production systems, and the strengthening of the EU’s global governance role as a leader in sustainable trade transformations.
