Abstract:
The existing literature insufficiently explains the common economic logic of adapting heterogeneous areas of national legislation to European Union law and the conditions under which short-term transition costs are converted into sustainable medium- and long-term benefits. The aim of the study is to identify and systematise the expected economic effects of adapting Ukrainian legislation in the areas of bankruptcy and insolvency, the right of establishment and freedom to provide services, and digital transformation and media. The methodological framework combines institutional and transaction-cost analysis, scenario comparison, comparative analysis and case-based reasoning, drawing on published findings of the European Commission, the OECD, the World Bank and UNCITRAL. The study identifies a common time profile of adaptation: in the short term, reforms increase public, administrative and compliance costs, while in the medium and long term they can reduce transaction costs and regulatory uncertainty, improve resource reallocation, expand access to services markets and lower digital risks. The specific transmission mechanisms include the preservation or reallocation of value in insolvency procedures, changes in entry barriers and cross-border activity in services, and reductions in information and risk costs in the digital environment. The scientific novelty lies in developing a common analytical framework that links regulatory change with direct transition costs, behavioural responses of economic actors, cross-sectoral spillovers and the resulting macroeconomic profile. The practical value of the results is the possibility of applying the framework to preliminary qualitative assessment of legislative decisions and to identifying the conditions of their economic effectiveness. The positive impact is shown to depend on proportionality of requirements, institutional capacity, accessibility of procedures for small and medium-sized enterprises, digital interoperability and consistent enforcement.
