Improving the State Regulation of Concession Activity in Ukraine (p. 27 - 32)
All over the world, governments in developed countries are taking the course to leverage the financial and other resources of the private sector in terms of public-private partnership in the development of industry branches that previously have been exclusively in property of the State, or have been considered monopoly of the State. Taking attention of the crisis circumstances, introduction of such mechanisms today is very relevant for our country. Improvement of the concession legislation will free up budgetary resources and will help to focus on the socially significant functions of the State authorities in the era of globalization. Degradation of infrastructure hampers social development and leads to additional expenses on the part of both government and business. One of the most effective ways to overcome resource constraints is to use the world-proven method of attracting additional funds through concessional financing. Standartization of problems of defining the spheres of responsibility of the authorities in normative-legal documents, observing the principles of transparency and avoiding information asymmetry by means of selection of financial and non-financial indicators of forecasting and monitoring of concession projects should facilitate, on the basis of best world practice, the introduction of a fair distribution of risks between the State and the private investor in conditions of external and internal threats of infringement of market equilibrium.
